---
Check kiting is a form of bank fraud that exploits the float period — the time it takes for a deposited check to clear — to artificially inflate account balances and withdraw funds that don't actually exist. The fraudster deposits a check drawn on Account A into Account B, then quickly withdraws the funds from Account B before the check drawn on Account A can be confirmed. By cycling checks between accounts before any of them actually clear, the kiter creates the illusion of having funds they don't have. Check kiting is a federal crime under the False Statement Act and bank fraud statutes, carrying potential prison sentences and civil [liability](/blog/examples-liabilities).

## How Check Kiting Works

The classic kiting scheme requires at least two bank accounts:

*A two-account kiting scheme cycles checks between banks before either clears, creating fictitious available balances.*

**Day 1**:
- Account A has a $0 balance
- Account B has a $0 balance
- Kiter deposits a $10,000 check drawn on Account A into Account B
- Bank B makes funds "available" immediately based on its float policy ($5,000 available same-day, rest in 2 days)

**Day 1 (same day)**:
- Kiter withdraws $5,000 from Account B (using the "available" float)

**Day 2**:
- Kiter deposits a $10,000 check drawn on Account B into Account A (before the Day 1 check clears)
- Account A now shows $10,000 deposited, covering the check that Bank B is about to present
- Kiter withdraws more from Account B

**The cycle**: Each check funds the other account's check, creating a daisy-chain of uncollected funds being used as if they're real. The scheme collapses when a bank refuses to make funds available before clearing, demands collection, or when the kiter cannot sustain the cycle.

## Types of Kiting

**Simple kiting**: Two-account scheme between two banks as described above.

*Check kiting takes four main forms, ranging from simple two-account schemes to coordinated corporate accounting fraud.*

**Complex kiting**: Multiple accounts at multiple banks, cycling large volumes of checks to maintain the illusion of cash. Some complex schemes have involved hundreds of accounts and tens of millions of dollars.

**Retail kiting**: Writing checks for purchases knowing the account has insufficient funds, with the intent to deposit funds before the check clears (hoping to cover the gap). Less systematic than bank-to-bank kiting.

**Structured kiting**: Coordinated across corporate accounts to manipulate reported cash balances in financial statements — a form of accounting fraud as well as bank fraud.

## Legal Consequences

| Charge | Statute | Maximum Penalty |
|---|---|---|
| Bank fraud | 18 USC § 1344 | Up to 30 years imprisonment, $1M fine |
| Wire fraud | 18 USC § 1343 | Up to 20 years per count |
| False statements | 18 USC § 1001 | Up to 5 years |
| Civil bank liability | UCC Article 4 | Full restitution to harmed banks |

The financial impact on banks can be significant — a sophisticated kiting scheme can result in millions of dollars of loss when it collapses, as all the "floated" funds simultaneously prove worthless.

## How Banks Detect Kiting

**Automated monitoring systems**: Banks use [transaction](/blog/what-is-a-transactions) monitoring software that flags patterns consistent with kiting:
- High-frequency check deposits immediately followed by large withdrawals
- Checks cycling between the same two or three accounts
- Account balance spikes followed by rapid drawdowns
- New account holders with unusual check activity in the first 30–90 days

**Collected funds vs. available funds tracking**: Modern bank systems track both the "available balance" (including float) and the "collected balance" (only actually cleared funds). Systematic gaps between these two balances signal potential kiting.

**[Federal Reserve](https://www.federalreserve.gov/) monitoring**: The Fed's check clearing system can detect cross-bank check cycling patterns that individual banks might miss.

**Correspondent banking flags**: When multiple banks are involved, correspondent banking relationships and clearing networks provide cross-bank visibility that helps detect complex schemes.

## Kiting in Corporate Accounting

**The accounting kite**: In financial statement fraud, a company can use check kiting to artificially inflate its cash balance at a balance sheet date. By depositing a large check that hasn't cleared before the year-end balance sheet date, and counting those funds as "cash," the company appears to have more liquidity than it actually does.

**Auditor response**: Auditors specifically test for kiting through:
- Bank confirmation letters from all banks
- Cutoff testing of check deposits near period end
- "Kiting schedule" (reconciling bank transfers around the balance sheet date)
- Review of bank-to-bank wire transfers in the days before and after the reporting date

The kiting schedule is a standard auditing procedure for any company with multiple bank accounts, specifically designed to catch this type of fraud.

## Legitimate Float Management vs. Kiting

Not all float management is kiting. **Legitimate practices**:
- Timing disbursements to maximise cash on hand (writing checks when funds are available)
- Using overnight cash sweeps to maximise interest on idle cash
- Clearing checks through the fastest available channel

**The line**: Legitimate practices work within the actual available funds. Kiting crosses into fraud when transactions are structured specifically to use funds the account doesn't actually have — exploiting the clearing delay to create fictitious cash.

## Conclusion

Check kiting is bank fraud that exploits the check clearing float to create illusory cash balances. The mechanics are straightforward (cycling checks between accounts before they clear), but the legal consequences are severe (federal fraud charges, up to 30 years). Banks detect kiting through transaction monitoring, collected vs. available balance tracking, and cross-institution clearing surveillance. For auditors and financial statement users, bank-to-bank transfer analysis at period end is the primary safeguard against kiting-based cash manipulation in reported financial statements.
